A prison inmate who resided in Brooks Correctional Facility in Muskegon, Michigan, will face up to six more years in jail for falsely accused his cell mate of raping him on August 2015.
Mlive.com reports Earl Upchurch, 52, pleaded guilty on June 30, for filing a false report of felony rape. As part of a plea agreement, Muskegon County Chief Circuit Judge William C. Marietti gave Upchurch a minimum of 12 months and up to 6 years in prison.
In return for his guilty plea, Upchurch was charged as a second-time habitual offender instead of a fourth-time, said Muskegon County Chief Assistant Prosecutor Timothy Maat. As a fourth-time offender, Upchurch would have been facing 15 more years in prison.
When asked about a motive for the false accusation, Matt said, “Investigators believe that he made up these accusations because he didn’t get along with the cell mate and wanted him removed from the cell, or he wanted to be removed from the cell.”
According to the Michigan Department of Corrections, Upchurch is now held at Oaks Correctional Facility in Manistee, Michigan. He also has convictions for breaking and entering, possession of burglar’s tools and intent to commit larceny.
